In February, Southwestern Law Review hosted a symposium on the 30th anniversary of the adoption of the California Evidence Code and noting the extension of the the California Bar Examination's coverage, for the first time, of California Evidence law. The symposium was named the CEC v. the FRE. I attended and submitted a paper, which will appear in the Review this fall. Here is the final draft of that paper, on the topic of preliminary fact determinations under the two regimens.
I have been on sabbatical during the Spring semester 2007 working on the second edition of my book, Criminal Law, published by McGraw-Hill. The new edition is scheduled for publication in the Spring of 2008.
